A comparison of the constitutional jurisdictions of two Eastern European transformation states on their path toward a consolidated rule-of-law state.
Especially in the aftermath of a political regime change, constitutional courts play a pivotal role in the transition to democracy. They serve both as guarantors of democratic transformation and the consolidation of the rule of law, and as symbols of the restoration of faith in justice.
This study, written with a German legal perspective in mind, examines constitutional jurisdiction in Hungary and Romania—both of which emerged in the same political era, namely in the years following 1989. However, these two Eastern European neighbours are also transformation states with distinct legal systems and legal traditions.
